A Terms and conditions for APV events

1.Organizer
Arbeitsgemeinschaft für Pharmazeutische Verfahrenstechnik e.V., Kurfürstenstraße 59, 55118 Mainz, Germany, represented by the President Prof. Dr. Jörg Breitkreutz.
2.Scope
2.1These terms and conditions apply to all events offered by the organizer - equally to on-site events (e.g., in-house training, workshops, internships, seminars, conferences, and exhibitions) as well as virtual meetings (e.g., webinars/live streams/virtual congresses and exhibitions) - unless differentiation is made.
2.2The conditions apply equally to consumers and companies.
2.3Differing, conflicting, or supplementary terms and conditions of the registrant, even if known, do not become part of the contract unless their validity is expressly agreed upon in writing.
3.Registration and Conclusion of Contract
3.1The contract is concluded by registration and confirmation of registration by the organizer. The confirmation of registration is made in writing, by email to the specified participant email address.
3.2Registration can be done by online registration, email, in writing, or by fax. The number of participants in the events is usually limited. Registrations are generally considered in the order of receipt. A waiting list is maintained.
3.3With online registration, clicking the "Bindingly register" button constitutes a paid registration for the presented event. Confirmation of receipt of registration is provided by an automated email immediately after submitting the registration and does not yet constitute acceptance of the contract.
3.4Registration implies acceptance of these terms and conditions.
3.5If a registration cannot be accommodated by the organizer, this will be communicated promptly. Acceptance of your contract offer by the APV is confirmed by our explicit registration confirmation, which we send to you in writing by email. Sending an invoice also constitutes acceptance.
3.6The APV is entitled to reject registration for an event without stating reasons.
4.Subject Matter of Contract and Contract Duration
4.1Further details of the contract, in particular, contents and procedures of the event as well as additional admission conditions, are determined exclusively by the information on the website and the event program of the respective event. Insofar as additional services of third parties, such as transport or accommodation services, are offered, these are not part of the contract. The contractual partner of such additional services is exclusively the respective service provider. The APV acts merely as an intermediary.
4.2The contract begins with receipt of our confirmation of registration and ends with the completion of the last day of the event.
5.Fees
The remuneration of the APV for the respective event ("event fees") is determined in terms of content and amount based on the information on the respective event page on our website, the event program, or the respective registration form. Events of the APV e.V. are exempt from value-added tax due to our non-profit status, provided they do not represent events individualized for companies that are not also made accessible to third parties outside the company.
6.Payment
6.1The participation fee becomes due before the start of the event upon invoicing, but no later than 10 days before the start of the event.
6.2The payment is due regardless of third-party services (e.g., employers). The due fee is to be paid by credit card, bank transfer, or PayPal, stating the invoice number.
6.3If the billing address differs from the participant's address, the differing billing address must also be provided. For a new invoice due to an unreported differing billing address, an additional processing fee of 20.00 euros will be charged.
7.Withdrawal and Termination by the Participant
7.1The participant can withdraw from the contract up to 43 days before the start of the event without having to pay a participation fee. A processing fee of 20 euros will be charged.
7.2If withdrawal is made within 42 to 14 days before the start of the event, the organizer is entitled to demand 50% of the participation fee.
7.3In the event of withdrawal within 13 days before the start of the event, the flat rate costs are 100% of the participation fee.
7.4The flat rate costs are waived if a replacement participant is registered. The division of an event among multiple participants is not possible. For issuing a new invoice due to a resulting differing billing address, an additional processing fee of 20.00 euros will be charged.
7.5The participant is free to prove that the organizer has suffered no or significantly less damage.
8.Withdrawal and Termination by the Organizer
8.1If the minimum number of participants is not reached, the organizer is entitled to withdraw from the contract up to 7 days before the start of the event.
8.2If it becomes impossible for the organizer to hold the event for reasons for which the organizer is not responsible, the organizer is entitled to withdraw from the contract.
8.3The withdrawal of the organizer may also be declared within the respective deadlines mentioned above.
9.Intellectual Property
9.1The contents made available in connection with the respective event are protected by copyright.
9.2Any duplication, editing, dissemination, and any kind of use outside the limits of copyright law require the prior written consent of the respective author or creator.
9.3Any violation will be prosecuted under civil and criminal law.
10.Liability
10.1The APV's liability for slightly negligent breaches of duty is limited to the foreseeable, contract-typical, direct average damage. This also applies to slightly negligent breaches of duty by the APV's legal representatives or vicarious agents.
10.2The APV is not liable for slightly negligent breaches of insignificant contractual obligations.
10.3The above limitations of liability do not apply to claims of the participant arising from guarantees and/or product liability. Furthermore, they do not apply to damages resulting from injury to life, limb, or health, as well as in the case of mandatory statutory regulations.
11.Data Protection
11.1The APV collects, processes, and uses personal data of the participant without further consent only to the extent necessary for the execution and processing of the contract and for billing purposes.
11.2Personal data will be treated confidentially and will not be passed on to third parties unless this is necessary for the execution of the contract.
11.3The participant agrees to receive further information from the APV by email. This consent can be revoked at any time.
12.Final Provisions
12.1Changes or additions to the contract or these terms and conditions must be made in writing. This also applies to changes to this written form requirement.
12.2Place of performance and jurisdiction is Mainz.
12.3Should individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
12.4German law applies exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

2.Scope
2.1These terms and conditions apply to all events offered by the organizer - equally to presence events (e.g., in-house training, workshops, internships, seminars, conferences, and exhibitions) as well as virtual meetings (e.g., webinars/live streams/virtual congresses and exhibitions) - unless differentiation is made.
2.2The conditions apply to consumers and companies alike.
2.3Divergent, conflicting, or supplementary General Terms and Conditions of the registering party, even if known, shall not become part of the contract unless their validity is expressly agreed upon in writing.
3.Registration and Conclusion of Contract
3.1The contract is concluded by registration and confirmation of registration by the organizer. The confirmation of registration is provided in writing, by email to the specified participant email address.
3.2Registration can be made online, by email, in writing, or by fax. The number of participants in the events is usually limited. Registrations are generally considered in the order of receipt. A waiting list is kept.
3.3By registering online, a binding registration for the displayed event is declared by clicking the "Register bindingly" button. The confirmation of receipt of the registration is sent by automated email immediately after submitting the registration and does not yet constitute acceptance of the contract.
3.4By registering, the validity of these terms and conditions is accepted.
3.5If a registration cannot be considered by the organizer, this will be communicated promptly. The acceptance of your contract offer by APV is made by our explicit confirmation of registration, which we will send to you in writing by email. Sending an invoice also constitutes acceptance.
3.6APV is entitled to reject registration for an event without giving reasons.
4.Subject Matter of the Contract and Contract Duration
4.1Further details of the contract, in particular, the content and procedures of the event as well as additional admission requirements, are determined exclusively by the presentations on the website and the event program of the respective event. Insofar as additional services of third parties, such as transport or accommodation services, are offered, these are not part of the contract. The contracting party for such additional services is exclusively the respective service provider. APV acts only as an intermediary.
4.2The contract begins upon receipt of our confirmation of registration and ends upon completion of the last day of the event.
5.Fee
The fee for the respective event ("Event Fee") of APV GmbH results in content and amount from the contents of the respective event page on our website, the event program, or the respective registration form. The prices and fees (including cancellation fees) stated are net prices. In addition, the statutory value-added tax is payable.
6.Payment
6.1The participation fee is due before the start of the event upon invoicing, but no later than 10 days before the start of the event.
6.2The payment obligation arises independently of third-party services (e.g., employer). The due fee must be paid by credit card, bank transfer, or PayPal, stating the invoice number.
6.3If the billing address differs from the participant's address, the differing billing address must also be provided. For issuing a new invoice due to a not provided differing billing address, an additional processing fee of EUR 20.00 is charged.
7Cancellation and Termination by the Participant
7.1The participant may withdraw from the contract up to 43 days before the start of the event without having to pay a participation fee. A processing fee of EUR 20 will be charged. Separate conditions apply to exhibitions under section B.
7.2If the withdrawal occurs within 42 to 14 days before the start of the event, the organizer is entitled to demand 50% of the participation fee.
7.3In the event of withdrawal within 13 days before the start of the event, the flat-rate charge is 100% of the participation fee.
7.4The flat-rate charge is waived if a substitute participant is registered. The division of an event among multiple participants is not possible. For issuing a new invoice due to a resulting differing billing address, an additional processing fee of EUR 20.00 is charged.
7.5The participant is free to prove that no damage or significantly lower damage has been incurred by the organizer.
8.Change of Event Date and Place
8.1APV reserves the right to change the location of the event for good cause (e.g., lack of participants or other unforeseeable obstacles).
8.2In the event of a relocation, the participants will be informed immediately. In the event of a relocation to another location in the same city or within 50 kilometers of the original location, the participants have no right of withdrawal. In the event of relocation beyond this scope, the participant has the right to withdraw from the contract.
9.Cancellation of the Event
9.1APV reserves the right to cancel the event for important reasons (e.g., if the minimum number of participants is not reached or the event leader fails). In this case, the participants will be informed immediately.
9.2If the event is canceled, the participation fee already paid will be refunded in full. Any further claims of the participant are excluded, except in cases of intent or gross negligence on the part of APV GmbH.
10.Liability
10.1APV is only liable for damages other than those resulting from injury to life, body, or health if these are based on intentional or grossly negligent acts or on culpable violation of a fundamental contractual obligation by APV, its legal representatives, or vicarious agents. A breach of a fundamental contractual obligation is the violation of an obligation that is essential for achieving the objective of the contract and on whose compliance the contractual partner regularly relies and may rely.
10.2In the event of a breach of material contractual obligations, APV is only liable for foreseeable damage typical of the contract if this was caused by simple negligence, unless it concerns claims for damages by the participant resulting from injury to life, body, or health.
10.3The above limitations of liability also apply in favor of the legal representatives and vicarious agents of APV if claims are asserted directly against them.
11.Data Protection
11.1The data collected in connection with the registration will be processed and used by APV GmbH to the extent necessary for the execution and processing of the event, as well as for documentation purposes, and will not be passed on to third parties unless this is necessary for the execution of the contract. Further information on data protection can be found on our website under "Data Protection".
12.Final Provisions
12.1Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. In such a case, the parties undertake to replace the invalid or unenforceable provision with a valid and enforceable provision that comes closest to the economic purpose pursued by the invalid or unenforceable provision.
12.2Amendments and supplements to this contract must be made in writing to be valid. This also applies to changes to this written form requirement.
12.3The law of the Federal Republic of Germany applies exclusively to contracts between APV and the participant, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
12.4The exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Mainz, Germany, provided that the participant is a merchant, a legal entity under public law, or a special fund under public law.

B Advanced participation conditions of the APV for exhibitions

18.Scope
18.1These supplementary and overarching terms of participation, referred to under B, apply additionally – to all conditions listed under Section A – to all exhibition opportunities offered (e.g., a Table Top presentation) on the occasion of an event organized by APV.
19.Table Top Presentation on the Occasion of an APV Event
19.1The number of Table Top spaces at the events is usually limited. Registrations will be considered in the order they are received. A waiting list will be maintained.
19.2Deviation from §§7.1-7.3 Cancellation Policy:
19.2.1Up to 91 days before the start of the event, an administrative fee of 25% of the stand fee will be charged.
19.2.290 - 1 day(s) before the start of the event or in case of a no-show: full calculation of the stand fee.
19.2.3In the event of reselling the booth space after your cancellation, we would refund you the stand fee minus 25% as administrative costs. This applies only if the exhibition is fully sold out at the time of your cancellation.
20.ResearchPharm® Exhibition as an Integral Part of the World Meeting on Pharmaceutics, Biopharmaceutics and Pharmaceutical Technology
20.1In addition to § 18: By booking a booth space at the ResearchPharm® Exhibition, you also accept the supplementary and overarching "Special Terms of Participation," which you can view on the ResearchPharm® website at: www.researchpharm.org/researchpharmr/terms-and-conditions/.
20.2The number of booth spaces is limited. Bookings will be considered in the order they are received. A waiting list will be maintained.
20.3Deviation from §§7.1-7.3 Cancellation Policy:
